Texas Estate Planning Lawyer

Flexible, legally sound estate plans after a Texas divorce

A legally sound estate plan is a necessity for anyone with assets, and especially parents of minor children. This is especially important for individuals who have been divorced and need a plan that is flexible and accounts for changing life circumstances like remarriage and the birth of additional children. The purpose of an estate plan is to:

  • Avoid excessive taxation and disputes with the government and I.R.S.
  • Avoid disputes between family members after your death
  • Ensure that your property and assets go where you want them to go

At WBR, our Plano, TX estate planning attorneys can assist you in developing and filing the broad range of potential Texas estate planning documents:

  • Simple Will – determines who receives your assets after your death and specifies care for any minor children.
  • Living Will – specifies what you do or do not want in terms of medical treatment should you be unable to communicate your wishes at a later time.
  • Durable Power of Attorney – names an individual who will make both decisions in your stead if you are unable to make them yourself. This includes both medical and financial decisions and are often called healthcare directives (or “proxies”)
  • Living Trust – a trust avoids probate by allowing you to pass your assets directly to a beneficiary upon your death without the intervention of the courts.

Texas Probate Attorney

“Probate“ is the legal process by which your assets are distributed to beneficiaries and heirs after your death. Our Texas probate lawyers at WBR can guide your family through the confusing requirements of the probate courts, including the filing of necessary documentation and the registration of the death certificate. Mistakes made during the probate process can lead to costly and time-consuming litigation, including disputes between family members and property left intestate (without a valid will). Our attorneys will ensure that you wishes are honored, legal rights preserved and any disputes resolved equitably between family members and the government.
